Terms of Service

Terms of Service.

The agreement between Peach and a school that holds an account. If you are an individual using Peach, the Terms of Use apply to you as well.

The agreement

These are Peach's standard service terms. The legal entity, address, start date and subscription term for a school are set out in its signed order or agreement.

Where these terms and a signed agreement with a school disagree, the signed agreement governs.

What Peach provides

An account covering every teacher, student and guardian at the school. It carries attendance, planning, assignments, marking, the gradebook, reports and outcomes. It carries messages and class channels, the staff assistant and the student tutor. It carries people and rosters, with imports and academic year rollover. It carries audit logs, exports, safeguarding and guardian access.

We may change how a feature works. We will not remove a capability the school depends on without telling the school first.

Accounts and roles

The school creates accounts and assigns roles. Access follows the role, so a teacher sees the classes they teach and a guardian sees their own child. The school is responsible for keeping its role assignments correct and for removing access when a person leaves.

Credentials are personal. Sharing a staff login is not permitted, because the audit log has to be able to say who approved what.

The school's responsibilities

  • Holding the consents it needs from guardians before creating student accounts.
  • The accuracy of the rosters, templates, rubrics and report formats it enters.
  • Reviewing what Peach prepares before it is used. Peach proposes, the school decides.
  • Telling us promptly if it believes an account has been misused.

How AI output is handled

Peach records when AI prepares a grading proposal. The school's AI grading policy determines whether teacher review is required before that proposal is released. Guardian reports and messages require a person at the school to release or send them. Attendance is confirmed before it is recorded.

The school remains responsible for the marks it awards, the reports it issues and the messages it sends. Peach keeps the relevant proposal, approval, release and correction history.

Drafts are generated text. They can be wrong. The review step is not a formality. It is the point at which the work becomes the school's own.

Acceptable use

  • Do not use Peach to harass, endanger or discriminate against a student, a member of staff or a guardian.
  • Do not attempt to reach records outside the role you were granted.
  • Do not probe, disrupt or attempt to circumvent the security of the service.
  • Do not resell access, or use the service to build a competing product.

Data and ownership

The school's records remain the school's. We process them to run the service and as described in the Privacy Policy. The school can export its records while the account is open and when it closes.

We own the software, the interface and everything we build. Nothing in these terms transfers that to the school, and nothing transfers the school's records to us.

Fees

Pricing is agreed with each school to fit what it needs. The amount, the billing period and any renewal terms are set out in the school's order or signed agreement.

Availability and support

We work to keep the service available and to restore it quickly when it is not. We do not promise uninterrupted availability. Planned maintenance is announced in advance where we can.

Support is by email at kanishk@peach.study and through the contact routes listed on the Contact page.

Suspending or ending the agreement

Either side may end the agreement by written notice, effective at the end of the current term unless the order says otherwise. The school can export its records before the account closes.

We may suspend an account immediately where there is a credible risk. That means risk to students, to another school's data or to the security of the service. We will tell the school why, and restore access once the cause is resolved.

Liability

Neither side excludes liability for anything that cannot lawfully be excluded, including death or personal injury caused by negligence, or fraud.

Any exclusions or limits of liability are set out in the school's signed order or agreement and apply only to the extent permitted by law.

Governing law

The governing law and forum are set out in the school's signed order or agreement.

Changes to these terms

We will give the school notice before a material change takes effect, and update the date at the top of this page.
